Do You Need a Real Estate Attorney to Buy a Home in Florida?

If you’re buying or selling a home in Florida, you may be wondering whether you need a real estate attorney or whether a title company is enough. Florida is a “title company state,” which means closings are often handled without an attorney — but that doesn’t mean legal guidance isn’t valuable. Here’s what buyers and sellers in Jupiter, Hobe Sound, and the surrounding areas should know.

Is a real estate attorney required in Florida?

No. Unlike some states, Florida does not legally require a licensed attorney to close a residential real estate transaction. Title companies and licensed title agents can prepare closing documents and issue title insurance. For a straightforward, low-risk purchase, that process often works smoothly.

However, a title company’s role is limited: they facilitate the closing and insure the title. They do not represent your interests, negotiate on your behalf, or advise you on the legal consequences of the contract you’re signing.

What a real estate attorney actually does

  • Reviews and negotiates the contract before you’re locked into terms.
  • Examines title issues — liens, easements, boundary problems, or gaps in the chain of title — and advises how to resolve them.
  • Structures the deal to protect you, especially where financing, contingencies, or entity ownership are involved.
  • Handles disputes that arise before or after closing, from inspection disagreements to breach-of-contract claims.

When you should strongly consider hiring one

An attorney is especially worthwhile when the transaction is anything but routine:

  • Commercial or investment property purchases
  • New construction, land, or properties with zoning or permitting questions
  • Deals involving trusts, LLCs, or multiple owners
  • Short sales, foreclosures, or properties with existing liens or title defects
  • Any transaction where a dispute has already surfaced

In these situations, the cost of legal counsel is usually small compared to the value of the property and the risk involved.
